Volunteer and Participant Waiver
VOLUNTEER & PARTICIPANT WAIVER, RELEASE OF LIABILITY AND CONSENT

The individual named below ("Participant") desires to participate in programs and/or activities ("Activity") partially or wholly coordinated by the Chicago Region Trees Initiative/ The Morton Arboretum_ ("Coordinating Organization") and its partners (collectively, the “PARTNERS”).

As lawful consideration for being permitted by the Coordinating organization and PARTNERS to participate in the Activity, Participant agrees to all the terms and conditions of this Waiver as set forth herein. Activities include, but are not limted to: standing, walking, sitting, bending, lifting, physical exertion, vehicular travel, use of hand tools and cutting implements, contact with other participants, navigating rough terrain, the effects of weather (including wet pathways).

 

1.      The Participant understands and agrees that IN ORDER TO PARTICIPATE IN THE ACTIVITY, PARTICIPANT WILL enter properties that Coordinating organization may neither own nor control and that it is possible that PARTICIPANT may be injured or otherwise harmed during the activitY due to accidents, acts of nature, or the negligent or intentional acts of Participant, Coordinating organization, PARTNERS, AND/or OTHER PARTICIPANTS. PARTICIPANT ACKNOWLEDGES THAT HE OR SHE IS VOLUNTARILY PARTICIPATING IN THE ACTIVITY WITH KNOWLEDGE OF THE DANGER INVOLVED AND HEREBY AGREES TO ACCEPT AND ASSUME ANY AND ALL RISKS OF INJURY, DEATH, OR PROPERTY DAMAGE, WHETHER CAUSED BY THE NEGLIGENCE OF THE COORDINATING ORGANIZATION, PARTNERS OR OTHERWISE.  

 

2.      Participant hereby expressly waives and releases any and all claims and causes of action, of whatever type he or she may have, whether these claims arise in law or equity, now known or hereafter known, in any jurisdiction throughout the world (collectively, "Claims"), against the Coordinating organization, PARTNERS, and their respective officers, directors, trustees, donors, employees, agents, affiliates, volunteers, successors, and assigns (collectively, “Releasees”), on account of personal injury, accident, illness (including death) and/or property loss, however caused, arising out of or attributable to Participant's participation in the Activity, whether or not caused in whole or in part by the negligent acts or omissions of one or more of the Releasees. Participant covenants and agrees not to make or bring any such Claim against the Releasees, and forever releases and discharges the Releasees from all liability under such Claims.  Participant further agrees that if, despite this Agreement, Participant or anyone on Participant's behalf, makes a Claim against any of the Releasees, Participant will indemnify, defend and hold harmless each of the Releasees from and against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind (including reasonable attorney fees, fees and the costs of enforcing any right to indemnification under this Waiver, and the cost of pursuing any insurance providers), incurred by or awarded against the Releasees, arising out or resulting from such Claims. 

 

3.      Participant irrevocably grants to Coordinating organization, PARTNERS and each member organization of PARTNERS, as well as their respective agents, employees, licensees, subsidiaries, successors in interest, and conservation partners (the "Likeness Parties"), the absolute and irrevocable right and permission to copyright, use, reproduce, publish and display, in any form now known or later developed, Participant's image or visual likeness (the “Likeness”) that may be obtained pursuant to Participant's participation in the Activity.  The Likeness may be copyrighted, used and/or published individually or in conjunction with other photography or video works, and in any medium and for any lawful purpose, including without limitation, trade, exhibition, illustration, promotion, publicity, advertising and electronic publication and Participant waives all rights to inspect or approve such Likeness.  Participant hereby releases the Likeness Parties (and all persons acting under their permission or authority) from any and all Claims arising out of the use, reproduction, adaptation, distribution, publication and display of the Likeness by the Likeness Parties. This release includes without limitation any Claims related to blurring, distortion, alteration, optical illusion, digital alteration, use in composite form, whether intentional or otherwise, or use of a fictitious name, that may occur or be produced in the processing or publication of the Likeness.

 

4.      If any term or provision of this Waiver is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Waiver or invalidate or render unenforceable such term or provision in any other jurisdiction.  This Waiver shall be binding upon and enforceable against Participant, as well as Participant's spouse, children, heirs and next of kin, personal representatives, executors, administrators, successors and assigns.

I hereby grant permission to the Coordinating Organization and its authorized agents to use my name, photograph, and video in connection with this project for any purpose including our publication, press releases, and on our websites.


Participant is a minor
If Participant is a minor, the undersigned parent or legal guardian of the Participant confirms and attests that he or she has the legal right to and, by signing below, the undersigned does hereby consent to the terms and conditions of this Waiver.

BY SIGNING BELOW PARTICIPANT CONFIRMS AND ATTESTS THAT PARTICIPANT HAS READ THIS WAIVER AND FULLY UNDERSTANDS ITS CONTENTS. PARTICIPANT IS AWARE THAT THIS IS A WAIVER AND RELEASE OF LIABILITY AND THAT PARTCIPANT IS VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS BY SIGNING IT AND THAT PARTICIPANT SIGNS THIS WAIVER ON HIS OR HER OWN FREE WILL WITHOUT ANY INDUCEMENT, ASSURANCE OR GUARANTEE.









Waiver Tree Planting
 (hereinafter referred to as the "Volunteer") has agreed to volunteer his/her time and energy to assist The Morton Arboretum (the "Arboretum") on a tree planting project 

for:

at the following location:
. Collectively, the Sponsor and the Arboretum shall be referred to herein as the “Coordinating Partners”.  
WARNING OF RISK   

The Coordinating Partners are committed to conducting this tree planting project in a safe manner and hold the safety of  the Volunteer in high regard. The Coordinating Partners strive to reduce risks of injury and therefore require that you, as  the Volunteer, follow safety rules and instructions that are designed to protect your safety.

Notwithstanding such precautions, you, as the Volunteer, are voluntarily participating in this activity with the knowledge of  the risks and dangers involved, which include, but are not limited to the following: contact with other participants, rough  terrain within the tree planting area, the effects of the weather (including wet pathways), travel to and from the tree  planting, equipment failures, and acts of God; all such risks to yourself being known and appreciated by you. Further, you  are acknowledging that not all hazards or dangers can be foreseen and that the Coordinating Partners cannot guarantee  absolute safety even with the precautions it is undertaking. 

You are solely responsible for determining if you are physically fit and/or properly skilled for this activity. It is always  advisable, especially if the volunteer is pregnant, disabled in any way, or recently suffered an illness, injury or impairment,  to consult a physician before undertaking any physical activity. 

WAIVER AND RELEASE OF ALL CLAIMS AND ASSUMPTION OF RISK 

As lawful consideration of, and as part of the payment for, the right to participate in the tree planting project, I hereby  expressly agree to be responsible for my own welfare and assume all of the above risks, including both those known and  unknown to me. 

As lawful consideration of, and as part of the payment for, the right to participate in the tree planting project, and as part of  the payment for the services arranged for me by the Arboretum, I HEREBY EXPRESSLY AGREE TO RELEASE, DISCHARGE AND  HOLD HARMLESS FOREVER the Coordinating Partners, their trustees, employees, shareholders, affiliated entities,  employees, agents, representatives, officers, directors, associates, volunteers, successors and assigns from and against any  liability, actions, causes of actions, debts, suits, claims and demands of any and every kind and nature whatsoever which I  now have or which may hereafter arise out of or in connection with the tree planting project or participation in the  activities arranged for me by the Coordinating Partners. I agree that the terms of this agreement shall serve as a complete release and express assumption of risk for myself, my heirs, successors, assigns, and legal representatives. It is my intention to fully assume all risks associated with this tree planting project and to release the Coordinating Partners from any and all liability to the maximum extent permitted by law. 

I further agree to indemnify the Coordinating Partners against any claim by any person arising in whole or in part from an injury or other loss suffered or caused by me in connection with my participation in the tree planting project.   

I have carefully read and understand the provisions and legal consequences of this agreement, and I hereby agree to all of its terms. I agree that execution of a facsimile counterpart or electronic transmission of this agreement shall be deemed execution of the original agreement.  


I hereby grant permission to the Arboretum and its authorized agents to use my name, photographs, videotapes, motion pictures in connection with this Project for any purpose including our publications, press releases, and on our websites.
